These Terms & Conditions (“Terms”/”T&C”) govern your use of our website findandseek.com and other sites we own and operate, including any of its subdomains (“Website”/“Site”), and cover products, services and technologies (collectively referred to as the “Products”/“Services”) provided by Find and Seek (the “Company”/“we”/“us”).

By using our Site, you agree to abide by these Terms and to comply with all applicable laws and regulations. If you do not agree with these Terms, you are prohibited from using or accessing our Site or using any other Products or Services provided us.

Our Products/Services

Find and Seek is an online boutique selling vintage fashion items, including but not limited to clothing, shoes, handbags, accessories and jewellery. We operate globally, providing our customers with a curated selection of unique pieces.

In addition to our sales, we offer an exclusive service within the UK which enables customers to rent select items from our collection for editorial purposes.

All vintage goods listed on our Site undergo a rigorous authentication process. Our team of experts ensures the authenticity and quality of every piece in our collection, fostering a trustworthy and seamless shopping experience.. As a customer, you can shop with the utmost confidence, knowing that each item we sell is genuine and of the highest quality.

Fair Use

We provide our Site, Products and Services with the assumption your use will be “business as usual” and set rules and guidelines designed to protect us, our users and customers and the general Internet community from unethical, irresponsible and illegal activity.

We are opposed to all forms of abuse, discrimination, rights infringement and/or any action that harms or disadvantages any group, individual or resource. We expect our users, customers and, where applicable, their users (“end users”) to likewise engage our Site, Products and Services with similar intent.

If your use is considered to be excessive, then additional fees may be charged or capacity may be restricted.

Users or customers found engaging in activities prohibited by these Terms can be liable for service suspension and account termination. In extreme cases, we may be legally obliged to report such customers to the relevant authorities.

Limitations of Use

By using our Site, Products or Services, you warrant on behalf of yourself, your users and other parties you represent that you will not:

  1. modify, copy, prepare derivative works of, decompile or reverse engineer any materials and software contained on our Site;

  2. remove any copyright or other proprietary notations from any materials and software on our Site;

  3. transfer the materials to another person or “mirror” the materials on any other server;

  4. knowingly or negligently use this Site or any of its associated services in a way that abuses or disrupts our networks or any other service that we provide;

  5. use our Site or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent or unlawful material;

  6. use our Site or its associated services in violation of any applicable laws or regulations;

  7. use our Site in conjunction with sending unauthorised advertising or spam;

  8. harvest, collect or gather user data without users consent; or

  9. use our Site, Products or Services in such a way that may infringe privacy, intellectual property rights or other rights of the Company or third parties.

Prohibited Activities

Find and Seek users or customers found engaging in activities prohibited by these Terms can be liable for service suspension and account termination. In extreme cases, we may be legally obliged to report such customers to the relevant authorities.

  • Copyright Infringement and Access to Unauthorised Materials

    Our Site, Products or Services must not be used to transmit, distribute or store any material in violation of any applicable law. This includes but isn’t limited to:

    • any material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorisation, and

    • any material that is obscene, defamatory, constitutes an illegal threat or violates export control laws.

The user/customer is solely responsible for all material they input, upload, disseminate, transmit, create or publish through or on our Site or in association with our Products/Services and for obtaining legal permission to use such material.

  • Spam and Unauthorised Message Activities

Our Site, Products or Services must not be used for the purpose of sending unsolicited bulk or commercial messages in violation of the applicable laws and regulations (“spam”). This includes but is not limited to sending spam, soliciting users/customers from spam sent from other service providers and collecting replies to spam sent from other service providers.

Our Site, Products or Services must not be used for the purpose of running unconfirmed mailing lists or telephone number lists (“messaging lists”). This includes but is not limited to subscribing email addresses or telephone numbers to any messaging list without the permission of the email address or telephone number owner and storing any email addresses or telephone numbers subscribed in this way. All messaging lists run on or hosted by us must be “confirmed opt-in”. Verification of the address or telephone number owner’s express permission must be available for the lifespan of the messaging list.

We prohibit the use of email lists, telephone number lists or databases purchased from third parties intended for spam or unconfirmed messaging list purposes on our Site, Products or Services.

This spam and unauthorised message activity policy applies to messages sent using our facilities as well as to messages sent from any network by the user/customer or any person on the user’s/customer’s behalf that directly or indirectly refer the recipient to our Site, Products or Services.

  • Unethical, exploitative, and malicious activity

    Our Site, Products or Services must not be used for the purpose of advertising, transmitting or otherwise making available any software, program, product or service designed to violate these Terms or terms and policies of other service providers. This includes but is not limited to facilitating the means to send spam and the initiation of network sniffing, pinging, packet spoofing, flooding, mail-bombing and denial-of-service attacks.

    Our Site, Products or Services must not be used to access any account or electronic resource where the group or individual attempting to gain access does not own or is not authorised to access the resource (e.g. “hacking”, “cracking”, “phreaking”, etc.).

    Our Site, Products or Services must not be used for the purpose of intentionally or recklessly introducing viruses or malicious code into our Site, networks and systems.

    Our Site, Products or Services must not be used for purposely engaging in activities designed to harass another group or individual. Our definition of harassment includes but is not limited to denial-of-service attacks, hate-speech, advocacy of racial or ethnic intolerance and any activity intended to threaten, abuse, infringe upon the rights of or discriminate against any group or individual.

    Other activities considered unethical, exploitative and malicious include:

    • Obtaining (or attempting to obtain) Products/Services from us with the intent to avoid payment;

    • Using our Site, Products or Services to obtain (or attempt to obtain) products/services from another provider with the intent to avoid payment;

    • Unauthorised access, alteration or destruction (or any attempt thereof) of any information about our users/customers or their end-users, by any means or device;

    • Publishing or transmitting any content of links that incite violence, depict a violent act, depict child pornography or threaten anyone’s health and safety;

    • Any act or omission in violation of consumer protection laws and regulations;

    • Any violation of a person’s privacy.

Our Site, Products or Services must not be used by any person or entity which is involved with or suspected of involvement in activities or causes relating to illegal gambling; terrorism; narcotics trafficking; arms trafficking or the proliferation, development, design, manufacture, production, stockpiling, or use of nuclear, chemical or biological weapons, weapons of mass destruction or missiles; in each case including any affiliation with others whatsoever who support the above such activities or causes.

Unauthorised Use of Find and Seek Property

We prohibit the impersonation of Find and Seek, the representation of a significant business relationship with Find and Seek or ownership of any Find and Seek property (including our Products and brand) for the purpose of fraudulently gaining service, custom, patronage or user trust.

User/Customer Accountability

We regard our users and customers as being responsible for their own actions as well as for the actions of anyone using our Site, Products or Services with their permission. This responsibility also applies to anyone using our Site, Products or Services on an unauthorised basis as a result of the user’s/customer’s failure to put in place reasonable security measures.

If a user/customer or their end-user violates our Terms, we reserve the right to terminate any Products/Services associated with the offending account or the account itself or take any remedial or preventative action we deem appropriate without notice. To the extent permitted by law, no credit will be available for interruptions of service resulting from any violation of our Terms.

Intellectual Property

The intellectual property in the materials contained on our Site or our other digital and print channels are owned by or licensed to the Company and are protected by applicable copyright and trademark law. Such materials can be used by our users only for personal non-commercial use.

This constitutes the grant of a licence, not a transfer of title. The Company reserves its right to terminate this licence at any time. This license shall automatically terminate if you violate any of these Terms or restrictions outlined by applicable law.

User-Generated Content

We consider “user-generated content” to be (including but not limited to) reviews, ratings, images, audio and video materials voluntarily supplied to us by users/customers for the purpose of publication on our Site or re-publishing on our social media channels.

You retain your intellectual property ownership rights over content you submit to us via our Site. We will never claim ownership of your content but we do require a license from you in order to use it.

When you use our Site or its associated services to post, upload, share or otherwise transmit content covered by intellectual property rights, you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide licence to use, distribute, modify, run, copy, publicly display, translate or otherwise create derivative works of your content. You also give us permission to use your username and other identifying information associated with your account in a manner that is consistent with your privacy preferences and our Privacy Policy.

The licence you grant us can be terminated at any time by deleting your content or account. However, to the extent that we (or our authorised representatives, third parties, agents or partners) have used your content in connection with commercial or sponsored content, the licence will continue until the relevant commercial, campaign or post has been discontinued by us.

Accuracy of Materials

The materials appearing on our Site are not comprehensive and are for general information purposes only. The Company does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on our Site or otherwise relating to such materials or on any resources linked to our Site.

You should not rely solely on the said materials to make decisions, we advise you to consult other, more complete sources of information. You are solely responsible for the strict reliance on the materials posted on our Site. We have the right to change the information on our Site without prior notice and users are responsible to monitor said changes. Any historical information present on our Site is provided for reference only.

Please note that the products may vary slightly from their pictures. The images of the Products on the Site are for illustrative purposes only. We wanted to make sure that the items visible on our Site are as close to life as possible, however, the item’s colours may be dictated by your device screen and/or settings and the item’s condition may be slightly different due to its vintage nature.

Inaccuracies and Mistakes

Please note that any content available on our Site may contain typographical errors, inaccuracies or mistakes related to the products/services description, pricing, promotion and availability. We have the right to cancel or update any existing orders should any information provided by us be proven inaccurate. Said information can be amended at any time without prior notice. Please note that we are not obligated to clarify any of the information related to our Site and products/services, including pricing information, except as required by law.

Third-Party Tools

Please note that our Site may include third-party tools which are outside of our control. The access to said tools is provided on an “as is” basis with no warranties, expressed or implied, and without any endorsement.

We are not liable for the use of the third-party tools provided on our Site. You are solely responsible for any risks associated with using said tools, we recommend reading the relevant third-party provider’s terms and conditions.

The Company has the right to offer new third-party tools in the future.

The Company is not responsible for the contents of any sites linked to our Site. The inclusion of any link does not imply endorsement, approval or control by the Company. Use of any such linked sites is at your own risk and we strongly advise you make your own investigations with respect to the suitability of such sites.

Security

We take great care in implementing and maintaining the security of the Site and your information by designing various layers of verifications and high-quality filters. Although we take reasonable steps to safeguard our platform and your information, we cannot be responsible for the acts of those who gain unauthorised access or abuse our Site, and we make no warranty, express, implied or otherwise, that we will prevent such access.

Please note that we cannot be held liable for the conduct of our users/customers. We are not liable for any fraudulent users and their actions, any such users violate the hereby Terms and will be permanently removed from our platform.

Disclaimer and Limitations of Liability

Our Site and the materials on our Site are provided on an '“as is” basis. To the extent permitted by law, the Company makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including, without limitation, implied warranties or conditions of merchantability, non-infringement of intellectual property or other violation of rights.

In no event shall the Company or its suppliers/service providers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use our Site or the materials on our Site, even if the Company or its authorised representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, “consequential loss” includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under the statute, contract, equity, tort (including negligence), indemnity or otherwise.

The Company makes no warranties or representations about the accuracy or completeness of the site’s content or the content of any websites linked to this site and assumes no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content and materials, (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Site, (3) any unauthorised access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from the Site, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the site by any third party, and/or (6) any errors or omissions in any content and materials or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the site.

The Company does not warrant, endorse, guarantee or assume responsibility for any product or service advertised or offered by a third party through our Site, any linked sites, or any sites or mobile applications featured in any banner or other advertising. We will not be a party to or in any way be responsible for monitoring any transaction between you and any third-party providers of products or services. As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

In no event will the Company or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data or other damages arising from your use of our Site, even if we have been advised of the possibility of such damages. Please note that we will not be held liable in the event of an accidental data breach or intentional abuse by a third party.

Registration, Orders and Payments

In order to use our Services or buy our Products, you may need to place an order with us and/or create an account with us. Any information provided has to be accurate and updated if necessary. Customers are liable for maintaining their accounts and are fully responsible for all activities occurring under their accounts. Should anybody gain unauthorised access to your account, you need to notify us immediately. The Company is not liable for any loss or damage arising from failure to maintain the confidentiality of your account and information.

When placing an order/creating your account with us, you are required to provide your personal information and information relevant to the chosen payment method. We are not liable for failed delivery of goods that may arise from providing incorrect, incomplete or missing information needed to finalise the order.

Please note that payments made via debit/credit cards, Apple Pay, Google Pay and PayPal will be processed by Stripe, PayPal or Klarna respectively (“payment processors”). As such, we will not be responsible for processing or retaining any of your financial information. Payment processors will handle all of your financial information per their respective terms and conditions that you agree to comply with.

Any payments made to us only cover the pricing of the goods as well as their shipment. As for any additional taxes and duties over which we have no control, the customer is responsible for complying with the laws applicable to the given country and will be liable for any such additional costs or taxes.

Shipping & Delivery

Orders are shipped through DHL within the UK, alongside other couriers outside the UK, depending on the destination. Please note that we may be subject to various rules and restrictions concerning some international deliveries and you may be subject to additional taxes and duties over which we have no control. If such cases apply, you are responsible for complying with the laws applicable to the country of destination and will be responsible for any such additional costs or taxes.

We have four main shipping options:

  • DHL Express UK which typically takes 1-2 business days for a cost of £25*

  • DHL Express Europe which typically takes 1-2 business days for a cost of £36*.

  • DHL Express North America which typically takes 2-3 business days for a cost of £45*.

  • DHL Express Asia and Australia which typically 3-4 business days for a cost of £58*.

*Shipping charges are based on DHL’s rates, with the understanding that we may need to adjust these charges if the actual rate comes back higher due to the dimensional weight of the package or the cost or nature of the goods.

Processing of most orders commences as soon as the online purchase is finalised. Your order will be shipped once the items are available, your payment is authorised and the delivery address is confirmed. Please be aware that business days exclude bank holidays and are from Monday to Friday.

The shipping details will be sent to the email address registered with your account or the email you used during the checkout process.

When assessing the expected delivery time, remember to factor in both processing time and the time it will take for the package to be shipped. Although we strive to deliver your items as quickly as possible, occasional delivery delays may occur.

All delivery times and dates we provide are estimates given in good faith. For our EU and UK customers, it’s important to know that these estimates do not affect your statutory rights.

Unless otherwise noted, the estimated delivery times reflect the earliest available delivery, and we commit to making deliveries within 30 days after we accept your order.

As per applicable law, the courier is responsible for any damage or loss during shipping. If your order is lost or you received your order damaged, please contact the shipment carrier to file a claim.

Duties and Taxes

Please note that all international parcels will need to go through customs before reaching the customer, who is responsible for paying the relevant customs duties. The Company does not partake in the customs process nor do we pay the customs duties on behalf of the customer.

The amount of fees depends on the country of delivery, the customer is responsible for verifying said fees before placing an order with us.

We are not liable for any packages that did not pass customs clearance due to the customer's refusal to pay the taxes. Failing to pay for the additional costs or taxes within 7 days of the goods arriving at customs may result in the termination of the goods by customs, we are not liable for such an event.

Returns

We accept returns within 14 days from the purchase date. Returned items must be in their original condition, unused, unwashed, unaltered and with all tags and labels attached. This includes the security tag which must be intact and unbroken.

Items must be returned in the original packaging, with all components included. For hygiene reasons, swimwear and undergarments must be tried on over personal underwear with the hygiene sticker intact.

Please note that a restocking fee of 10% applies to all returns.

Sale or discounted items are final sale and cannot be returned.

To return an item, please email customer service at customercare@findandseek.com to obtain a Return Merchandise Authorisation (RMA) number. After receiving an RMA number, place the item securely in its original packaging and the return form provided, then mail your return to the following address:

You may also use the prepaid shipping label enclosed with your package. Return shipping charges will be paid or reimbursed by us.

Refunds

After receiving your return and inspecting the condition of your item, we will process your refund. Please allow at least 14 days from the receipt of your item to process your refund.

You will receive the refund through the same payment method you used to make the purchase. Please note that refunds may take up to 10 days to appear on your account/statement. We will notify you by email when your return has been processed on our end.

If for any reason we are unable to issue a refund via your initial payment method, we will provide the value in equivalent credit or provide an alternate method of refund.

Please note that some payment methods available in your jurisdiction may not support refunding a purchase back to the original payment method.

Rentals

We provide an exclusive service of editorial rentals within the UK. Our collection comprises a vast selection of vintage fashion items, including but not limited to clothing, shoes, handbags, accessories and jewellery. The Products for rental listed on the Site (“rentals”) are and will at all times remain the absolute property of the Company.

Please note that rentals are subject to availability and our team’s discretion. We reserve the right to refuse rentals for any reason.

The rental fee, when not stated on our Site, is agreed between the Company and the customer. Rental fees are applied per item, per day, unless otherwise agreed between the Company and the customer. In addition, the customer will be charged a rental deposit in the amount defined by the Company.

The rental period, when not stated on our Site, is agreed between the Company and the customer and shall commence from when the customer (or a third party nominated by the customer) receives the ordered rental(s) and shall continue until the rental(s) are returned to the Company.

Additional fees will be applied for every day beyond the agreed rental period until the rental is returned. If the rental is not returned after 10 days the item will be classed as lost/stolen and the customer will be charged the full cost of the rental(s) on top of the late fees already charged; the deposit amount will be deducted from such costs.

The customer is solely responsible for the rental(s) they have rented and is therefore liable for any damage or loss that may occur during the rental period and/or during the rental(s) being in the Customer’s custody or control. In case of any damage or loss, the customer will be charged the full cost of the rental(s); the deposit amount will be deducted from such costs. Please note that damage assessment is at the discretion of the Company’s experts.

Indemnification

You agree to defend, indemnify and hold us harmless, including our subsidiaries, affiliates and all of our respective officers, agents, partners and employees, from and against any loss, damage, liability, claim or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of our Site, Products or Services; (2) breach of these Terms; (3) any breach of your representations and warranties set forth in these Terms; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other Find and Seek’ user/customer.

Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us and you agree to cooperate, at your expense, with our defence of such claims. We will use reasonable efforts to notify you of any such claim, action or proceeding which is subject to this indemnification upon becoming aware of it.

Termination

We may suspend or terminate your right to use our Site, Products or Services and terminate these Terms immediately upon written notice to you for any breach of these Terms.

Severance

Any term of these Terms which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms is not affected.

Entire Agreement

These Terms and any policies or operating rules posted on our Site or with respect to our Site, Products or Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. These Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay or failure to act caused by any cause beyond our reasonable control.

If any provision or part of a provision of these Terms is determined to be unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms or use of our Site. You agree that these Terms will not be construed against us by virtue of having drafted them. You hereby waive any and all defences you may have based on the electronic form of these Terms and the lack of signing by the parties hereto to execute these Terms.

Governing Law

These Terms and any policies or operating rules posted on our Site or with respect to our Site are governed by and construed in accordance with the laws of the United Kingdom. You irrevocably submit to the exclusive jurisdiction of the courts in that location.
